MANILA — The Court of Appeals (CA) on Monday selected the justices who will handle the case filed by Anthony Menorca against the leadership of the Iglesia Ni Cristo (INC).
The case involves the alleged abduction and putting into custody of his brother Lowell Menorca, wife Jinky Otsuka, daughter Yurie and househelp Abegail Yanson.
The CA Seventh Division, chaired by Associate Justice Magdangal de Leon, together with its two members Associate Justices Elihu Ybanyez and Victoria Isabel Paredes, are now handling the petition which was earlier filed before the Supreme Court (SC).
Associate Justice Paredes was assigned as the “ponente” or writer of the resolution and decision in the case.
Meanwhile, the respondent INC officials on Monday filed before the CA their respective manifestation and motion.
The SC last Friday ordered INC Executive Minister Eduardo Manalo to present before the CA the living bodies of its members who were allegedly abducted.
In a two-page writs of amparo and habeas corpus issued by the SC en banc against Manalo last Friday, it directed the CA to set the hearing and render a decision on the petition filed by Anthony Menorca and Jungko Otsuka.
Anthony Menorca is the brother of Lowell Menorca, who was allegedly abducted and hidden at the INC Central Office, in Commonwealth, Quezon City, together with his wife, daughter and their househelp.
The SC also ordered Manalo to appear and bring along with him Lowell Menorca, Jinky Otska-Menorca, Yurie Keiko Otsuka and Abegail Yamson before the CA on Nov. 3, 2015 at 10 a.m.
Likewise, the SC directed Manalo and the other INC leaders to submit their respective comments on the petition through a “verified return” of the writs to the CA within a period of five days from Friday. Philippine News Agency
