COMELEC ASKED TO NULLIFY DUTERTE’S COC FOR PRESIDENT

MANILA — A Quezon City registered voter on Friday asked the Commission on Elections (Comelec) to nullify the certificate of candidacy (COC) for president filed by Davao City Mayor Eduardo Duterte.

Ruben Castor of Bagong Silang, Quezon City, in his petition submitted to the Comelec Friday, noted that based on the CoC submitted by Martin Dino, the CoC filed by Duterte was for the mayoralty post and not for the presidential post.

“The CoC of respondent Dino is for Mayor of Pasay. Therefore, he can withdraw his candidacy only for Mayor of Pasay and not for President,” he said in his 8-page petition.

He added, “There is clearly no candidate for president who is withdrawing his candidacy for the same position of president; there is none that respondent Duterte may substitute.”

Castor explained that Duterte could not substitute Dino since the latter’s CoC was invalid.

“He (Duterte) should not substitute Dino whose COC is void, legally inexistent and without legal effect; hence substitution shall be likewise void…The CoC of Dino, consisting of false representations is void for being against the mandatory provision of law,” he added.

Likewise, he pointed out that Duterte was nominated by Hugging sa Tawong Lungsod as mayor for the said city, and not by PDP-Laban, the party he belongs to.

“It is most respectfully submitted that the honorable commission should not allow a travesty of justice and the law, distortion of truth and make it legally possible for the commission to give due course to the substitution of respondent Dino by respondent Duterte for the position of president,” Cas said.

On Friday, Duterte withdrew his CoC for mayor of Davao City and filed his CoC for president thru Atty. Salvador Medialdea. Ferdinand G. Patinio /PNA
